Terms of Service

1. Acceptance of Terms

By accessing or using Tracken ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of Service

Tracken is an AI search visibility platform that monitors and analyzes how AI-powered search engines reference, mention, and recommend brands. The Service includes visibility tracking, competitive intelligence, content optimization tools, and reporting features.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Subscription & Billing

• Paid plans are billed monthly or annually in advance
• Free trials last 7 days and do not require a credit card
• You may cancel your subscription at any time from the billing settings
• Refunds are handled on a case-by-case basis within 14 days of charge
• Prices may change with 30 days' notice to active subscribers

5. Acceptable Use

You agree not to:

• Use the Service to violate any applicable law or regulation
• Reverse-engineer, decompile, or attempt to extract the source code
• Resell, sublicense, or share your account access without authorization
• Interfere with or disrupt the integrity of the Service
• Use automated means to access the Service beyond the provided API

6. Intellectual Property

You retain ownership of your data. Tracken retains ownership of the platform, technology, and all related intellectual property. Aggregated, anonymized usage data may be used to improve the Service.

7. API Usage

API access is available on the Scale plan. API keys are confidential and must not be shared publicly. Rate limits apply per your plan. We reserve the right to throttle or suspend API access for abuse.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. Tracken shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the Service ceases immediately. Data retention follows our Privacy Policy.

10. Changes to Terms

We may update these terms from time to time. We will notify active users of material changes via email at least 30 days in advance. Continued use of the Service after changes constitutes acceptance.
